By accessing or using the SwissBorg platform (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Service.
2. Eligibility
You must be at least 18 years old to use our Service. The Service is available in 47 countries as listed on our website. You are responsible for ensuring that your use of the Service is lawful in your jurisdiction.
3. Our Services
SwissBorg provides:
- A cryptocurrency exchange and trading platform
- Crypto portfolio management tools
- Yield-generating products ("SwissBorg Earn")
- Auto-invest and Trigger Order features
- BORG token staking and governance participation
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
4. Your Account
You must complete our KYC (Know Your Customer) verification to access all platform features. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Providing accurate and up-to-date information
- Notifying us immediately of any unauthorized access
5. Prohibited Activities
You agree not to:
- Use the Service for money laundering or terrorist financing
- Create multiple accounts or impersonate other persons
- Attempt to reverse-engineer or hack the platform
- Use automated bots or scrapers without our written consent
- Engage in market manipulation or wash trading
- Violate any applicable laws or regulations
6. Risk Disclosure
Cryptocurrency investments carry significant risks. You acknowledge that:
- Crypto-asset prices are highly volatile and can fall to zero
- Past performance does not guarantee future results
- Regulatory changes may adversely affect the value of your assets
- Technical failures, hacks, or network issues may result in losses
- You should only invest what you can afford to lose
7. Fees
Our fee structure is transparent and available in the app. We charge fees on trades, withdrawals, and certain premium features. Fees may vary based on your SwissBorg Rank (tied to BORG token locked). We reserve the right to update our fee schedule with 30 days' notice.
8. Limitation of Liability
To the maximum extent permitted by law, SwissBorg shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you to SwissBorg in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your account at any time for breach of these Terms, regulatory requirements, or at our discretion. Upon termination, you may withdraw your funds subject to applicable laws and any pending investigations.
10. Governing Law
These Terms are governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lausanne, Switzerland, except where mandatory consumer protection laws in your country provide otherwise.
